The Weedmaps Referral Program (“Referral Program”) is by invitation only, extended at Weedmaps’ discretion to select consumer account holders , who are of legal age to participate (“Invitees”).
Employees (and members of their households and immediate families (spouses, parents, siblings, children and each of their respective spouses)) of Weedmaps, its parent company, subsidiaries, and affiliates, and its advertising and promotion agencies are not eligible to participate in the Referral Program. For the purposes of these Terms, “employees” shall include all individuals who have entered into an employee, independent contractor and/or consultant agreement with the Weedmaps or any of its affiliates.
Invitees will receive a unique referral link to share with their friends 21 years of age or older.
Friends must successfully sign up for a new Weedmaps account using the unique referral link during the specified contest period to be considered a qualified referral (“Qualified Referral(s)”).
The number of winners and specific prizes for a Referral Contest (defined below) will be determined by Weedmaps in its sole discretion.
The top Invitee(s) with the most Qualified Referrals at the end of a specified contest period will be eligible to win one or more prizes.
Prizes may include merchandise or promotional offers. Weedmaps reserves the right to modify or substitute prizes in its sole discretion at any time without prior notice.
To the extent permitted by applicable law, all prizes are awarded “as is” and without warranty of any kind, express or implied, in fact or in law (including, without limitation, any implied warranty of satisfactory quality, merchantability or fitness for a particular purpose).
Prizes are non-transferable and cannot be exchanged for cash or other alternatives.
Each Referral Contest will run for a specified period, with a specified start and end date.
Referrals completed outside of the specified contest period will not be counted.
Winners will be selected based on the number of Qualified Referrals they generate within the specified contest period.
Weedmaps will notify winners via email within a reasonable time after the contest ends.
To receive their prize, winners will need to reply within the instructed timeframe to provide a postal mailing address, verify their age with a government-issued ID, and sign a prize release form.
These Weedmaps Referral Program Terms and Conditions (“Terms”) constitute Additional Terms between Weedmaps and you governing your participation in referral programs administered by Weedmaps (each, a “Referral Contest”, and collectively, the “Referral Program”). Capitalized terms used but not defined herein have the meanings assigned to them in the Terms of Use. Weedmaps will collect, use, disclose and protect personal information under the Referral Program in accordance with the Privacy Policy (together with the Terms of Use, the “Website Terms”). The Website Terms are incorporated into and form part of these Referral Terms. To the extent there is a conflict between the Website Terms and these Referral Terms, the Website Terms shall control.
Each Referral Contest may have additional terms and conditions governing eligibility and additional program details (“Additional Contest Terms”). In addition, there may be other terms (“Additional Reward Terms”) that apply to any referral incentive offered in connection with a Referral Contest, which may include entries for promotions or giveaways, cash incentives, access to private events, prizes, or other types of rewards (each, a “Referral Reward”). In the event there is a conflict between these Referral Terms and the Additional Campaign Terms or Additional Rewards Terms, as applicable, the Additional Campaign Terms or Additional Rewards Terms, as applicable, shall control with respect to the applicable Referral Campaign or Referral Reward to the extent of the conflict. Void where restricted or prohibited by law.
In connection with the Referral Program, you agree not to: (i) Use Weedmaps’ intellectual property, such as our logos, name, trade dress or other promotional materials, except to identify yourself as a Weedmaps User, or including by registering any new domain names, products, or otherwise that incorporate “Weedmaps” or any words confusingly similar to our trademarks (including via purchasing keywords containing any such marks); (ii) Make false or misleading claims or give a misleading impression about Weedmaps, your affiliation with us or any other third party, or the Referral Program. For the avoidance of doubt, you have no authority to assume or create any obligation or warranty, express or implied, on behalf of Weedmaps to represent Weedmaps in any capacity, except as expressly set forth in these Terms (and any applicable Additional Contest Terms); (iii) Use your unique referral link in any manner that violates the law (e.g., by providing your unique referral link to minors to induce them to register for an account impermissibly) or anyone else’s rights (e.g., by attempting to defraud us).
In addition to the general requirement that you are only permitted to use your unique referral link in compliance with applicable law, we are calling your attention to the Guides Concerning the Use of Endorsements and Testimonials in Advertising (“Endorsement Guidelines”) published by the Federal Trade Commission (“FTC”). Since you anticipate receiving a prize for Qualified Referrals, you may be deemed an affiliate endorsing Weedmaps under the Endorsement Guidelines. To protect yourself (and us), anywhere you share your unique referral link, you should include clear, concise disclosures that we are compensating you in connection with eligible referrals. In addition to the Endorsement Guidelines linked above, the FTC’s “.Com Disclosures” has helpful guidance on how to comply with the rules in your online communications.
Weedmaps may make changes to these Referral Terms from time-to-time without prior notice and in its sole discretion, including by terminating or modifying a Referral Contest or the Referral Program at any time and for any reason. See the Website Terms for additional details regarding how any such material changes will be communicated.
Weedmaps and its respective affiliates, partners, subsidiaries, parent, advertising and promotion agencies, and each of their officers, directors, shareholders, members, owners, employees and agents, and any and all Internet servers and access provider(s) are not responsible for: (i) any incorrect or inaccurate entry information; (ii) printing or human or other errors; (iii) technical malfunctions; (iv) failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to your or any other person’s computer relating to or resulting from participation in the contest(s); (v) inability to access Weedmaps website; (vi) theft, tampering, destruction, or unauthorized access to, or alteration of entries; (vii) entries that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any web site; and (viii) any entries which are late, lost, incomplete, misdirected, stolen, or any combination thereof.
By sharing your unique referral link or by otherwise participating in the Referral Program, you are agreeing to be bound by these Terms, the Website Terms, and any applicable Additional Campaign Terms and Additional Reward Terms.
Your eligibility for participation in the Referral Program is expressly conditioned on your adherence to the Website Terms, these Referral Terms, and any Additional Campaign Terms and Additional Reward Terms (collectively, “Applicable Terms”). If you violate any provisions of the Applicable Terms, in addition to any remedies, rights or actions reserved in the Website Terms, which govern any disputes related to or arising out of the Referral Program, Weedmaps may: (i) remove your eligibility to participate in the Referral Program; (ii) withdraw any prizes or incentives earned in violation or suspected violation of these restrictions; or (iii) take any other remedial action that Weedmaps determines is necessary or appropriate in its sole discretion, including suspension or termination of your Account without prior notice to you. Any attempt to deliberately damage any website or undermine the legitimate operation of a contest may be in violation of criminal and civil laws and should such an attempt be made, Weedmaps reserves the right to seek remedies and damages (including attorney’s fees) from you to the fullest extent of the law, including criminal prosecution.
